On January 3, 2008, the US International Trade Commission (ITC) decided to designate Paul J. Luckern as an administrative judge to conduct a hearing investigation on the application for an injunction issued by Seoul Semiconductor on December 4, 2007. Nichia Corp., a Japanese LED manufacturer, investigates short-wavelength semiconductor lasers (built into consumer electronics such as high-definition DVD players).
The lawsuit between Seoul Semiconductor and Nichia's two major LED manufacturers has been delayed for several years. Nichia was announced on December 28, 2007, and has filed a lawsuit against Seoul Semiconductors in the Central District Court of Seoul, South Korea, in addition to claiming damages of 500 million won, and demanding that the other party be responsible for the restoration of necessary measures related to reputation.
Seoul Semiconductor announced in November 2007 that the Northern California District Court had pronounced that only one of the four products previously indicted by the company was infringed. According to the press release, the infringing product was confirmed to be "side view LED 902" for mobile phone backlights sold in the United States, and the product has been discontinued.
