3. The Ministry of Finance and the National Development and Reform Commission comprehensively consider the progress of government procurement reform and the technology and market maturity of energy-saving products, and determine the scope of government procurement by category from energy-saving products certified by nationally recognized energy-saving product certification bodies. The form of “Government Procurement List of Energy-Saving Products†(hereinafter referred to as “Energy Saving Listâ€) is published.
The newly added energy-saving certification products in the energy-saving list will be determined, announced and adjusted in time by the Ministry of Finance and the National Development and Reform Commission.
4. The China Government Procurement Network, China Environmental Resource Information Network, and China Energy Conservation and Water Conservation Certification Network are the media for the energy conservation list. In order to ensure the accuracy of the above information, it may not be reproduced without the permission of the Ministry of Finance and the National Development and Reform Commission.
5. The effective time of the products in the energy-saving list shall be subject to the effective expiration date of the national energy-saving product certification certificate, and the automatic expiration date of the validity date of the certification certificate shall expire.
6. When government procurement is a product in the energy conservation list, under the same conditions of technical and service indicators, the energy-saving products listed in the energy-saving list shall be preferentially purchased.
7. In the government procurement activities, the purchaser shall specify the energy-saving requirements for the products, the conditions of the qualified products and the evaluation criteria for the priority procurement of the energy-saving products in the government procurement bidding documents (including negotiation documents and inquiry documents).
8. If the purchaser or its entrusted procurement agency fails to purchase according to the above requirements, the relevant departments shall handle it in accordance with relevant laws, regulations and rules, and the financial department may refuse to pay the purchase funds as the case may be.
IX. This opinion adopts a positive, steady and step-by-step implementation method and gradually expands to the whole country. In 2005, it was implemented at the central level budget unit and at the provincial level (including the city with separate plans). In 2006, it was extended to the central secondary budget unit and the prefecture-level budget unit. It was fully implemented in 2007.
